This is the only Terms of Service governing gijad.com; any prior versions are superseded.

1) Introduction

Welcome to www.gijad.com (the “Site”). The Site is owned and operated by GIJad (“we,” “us,” “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use the Site.

IMPORTANT MEDICAL NOTICE: The Site provides general educational information and is not medical advice. Please read Section 8 carefully.

2) Definitions

  • “User” means any person who accesses or uses the Site.

  • “Content” means text, graphics, images, audio, video, documents, templates, instructions, and other materials made available on or through the Site, whether provided by us or others.

  • “User Content” means any content you submit, post, upload, transmit, or otherwise make available through the Site (including messages, forms, comments, and uploads).

3) Eligibility; Not for Emergencies

You represent that you are at least 18 years old and capable of forming a binding contract.

The Site is not for emergency use. If you believe you may have a medical emergency, call 911 or go to the nearest emergency department.

4) Scope of Services

The Site provides general educational information. We do not provide medical services, diagnosis, treatment, prescriptions, or patient-specific recommendations through the Site. We do not provide medical, legal, financial, or other professional services through the Site.

5) Acceptable Use

You agree to use the Site only for lawful purposes and in compliance with these Terms. You agree not to:

  1. Use the Site in any way that violates applicable laws or regulations.

  2. Misrepresent your identity or affiliation with any person or entity.

  3. Interfere with, disrupt, damage, or gain unauthorized access to the Site, servers, or networks.

  4. Introduce malware, viruses, worms, spyware, or other harmful code.

  5. Scrape, crawl, harvest, or collect information from the Site by automated means without our prior written permission.

  6. Reverse engineer, decompile, or attempt to discover source code or underlying ideas of the Site except to the extent prohibited by law.

  7. Use the Site to generate, promote, or facilitate unlawful, harmful, or deceptive activity.

We may investigate and take any action we deem appropriate in response to violations, including suspending or terminating access.

6) Accounts (If Applicable)

Certain features may require an account. You agree to provide accurate information and keep it current, maintain the confidentiality of your credentials, and accept responsibility for all activity under your account. We may suspend or terminate accounts for suspected unauthorized use or violations of these Terms.

8) Medical Disclaimer; No Medical Advice; No Physician–Patient Relationship

Educational Purpose Only. The Site provides general educational information and is not medical advice, diagnosis, or treatment. You agree not to use the Site to make or confirm a diagnosis, select treatment, adjust medication dosing, or manage an emergency. We do not provide medical, legal, financial, or other professional services through the Site.

No Physician–Patient Relationship. Use of the Site does not create a physician–patient relationship or any other fiduciary relationship between you and us.

No Reliance / No Delay. Do not disregard or delay seeking professional medical advice because of Content on the Site. Always consult your own qualified clinician for questions regarding symptoms, diagnoses, medications, and treatment.

Variability of Medical Information. Clinical information changes over time. Recommendations can differ based on individual circumstances, comorbidities, medication formulation and dose, and prescribing instructions. You are responsible for following directions from your prescribing clinician and pharmacist. AI/Automation Notice. Some Site features may use automated or AI-assisted methods. Outputs may be incomplete, inaccurate, or inappropriate for your situation. You are solely responsible for verifying information with authoritative sources and your own clinical judgment.

Emergencies. If you think you may have a medical emergency, call 911 or go to the nearest emergency department.

9) No Warranties

THE SITE AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR RELIANCE ON ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the fullest extent permitted by law.

11) Assumption of Risk

You understand and agree that any use of the Site and Content is at your own risk, including any reliance on educational materials relating to medical conditions, medications, or treatments.

12) User Content; License; Prohibited Submissions

License. If you submit User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to host, use, reproduce, modify, publish, display, distribute, and create derivative works of such User Content to operate, improve, and promote the Site.

License. If you submit User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content as necessary to operate and maintain the Site, and to use de-identified and aggregated information derived from User Content to improve the Site. We will not publicly display your User Content in a way that identifies you without your consent, except as required to operate the Site (e.g., showing your own submissions to you) or as required by law.

Your Responsibilities. You represent and warrant that you have the rights to submit the User Content and that it does not infringe others’ rights or violate law.

Do Not Submit Sensitive Medical Information. Unless the Site explicitly provides a dedicated, secured feature for that purpose (and states it is intended for that purpose), do not submit personal health information (e.g., medical record numbers, full clinical histories, test results, images, or other identifying health data) through general web forms, chat boxes, or email links on the Site.

We may remove User Content at any time in our discretion.

13) Intellectual Property

All Site Content (excluding User Content) is owned by us or our licensors and is protected by intellectual property laws. You may access and use the Site for your personal, non-commercial use only. You may not copy, reproduce, distribute, sell, create derivative works from, or exploit Site Content without our prior written permission, except as permitted by law.

14) Third-Party Links and Services

The Site may link to third-party websites or services. We do not control and are not responsible for their content, policies, or practices. Your use of third-party sites is at your own risk and subject to their terms.

15) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, Sections that by their nature should survive will survive, including Sections 8–13 and 16–19.

16) Indemnification

You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, contractors, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or third-party right.

17) Governing Law; Venue

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

Unless arbitration is required under Section 18 (if adopted), you agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction and venue in those courts.

18) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the effective date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

19) Miscellaneous

  • Severability. If any provision is found unenforceable, the remaining provisions remain in effect.

  • No Waiver. Our failure to enforce any provision is not a waiver.

  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

  • Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Site.
